Ontario Extends Orders Issued Under Declared Emergency
Earlier today the government of Ontario announced that most of the active emergency orders issued under the Emergency Management and Civil Protection Act have been extended until September 22, 2020. While the authority to issue these orders requires a state of emergency to be in effect (the emergency officially ended on July 24, 2020), the government originally extended their application for a 30-day period by passing the Reopening Ontario (A Flexible Response to COVID-19) Act, 2020. We previously blogged on the effects of that legislation here.
The most notable exception to this extension relates to the emergency order suspending timelines and limitation periods for legal proceedings. That order will cease to apply beginning on September 14, 2020. This means that suspended timelines and limitation periods will continue to run thereafter.
